Article 1 - PurposeThese conditions govern sales to design enthusiasts (hereinafter "users") by the company PIÈCE MAÎTRESSE by Laure SAS 34 boulevard Ornano, 75018, Paris on the website www.piece-maitresse.com (hereinafter the "Site"):
- small pieces of designer furniture, original works of art and one-of-a-kind or limited edition objets d'art (hereinafter referred to as "Pieces"), ordered directly from the designers who designed them and who are responsible for producing them or having them produced (hereinafter referred to as "Designers"). The order is placed by Pièce Maîtresse by Laure with the Designers, once the pre-order campaign has been completed on the Pièce Maîtresse by Laure website.small designer furniture items, original works of art and one-of-a-kind or limited edition objets d'art, purchased directly from Pièce Maîtresse by Laure SAS (hereinafter the "Pieces").The purpose of these terms and conditions is to define the terms and conditions of online sales offered on the Site and to define the rights and obligations of the parties in this context. They also govern the services offered to Users independently of online sales (hereinafter referred to as the "Services").
They can be accessed and printed at any time via a direct link at the bottom of the Site page.
They may be supplemented, where applicable, by specific terms of use for certain Services, which supplement these general terms and conditions and, in the event of contradiction, take precedence over them.
Article 2. Site Operator - Contact
The Site is operated by Pièce Maîtresse by Laure SAS, SIREN ID 919 580 126, whose registered office is located at 34 boulevard Ornano, 75018, Paris (hereinafter: "Pièce Maîtresse by Laure").

Article 3. Access to the Site and Services - Delivery territories
3.1 Legal capacityThe Site and Services are accessible :
- Any natural person who is at least 18 years of age and has full legal capacity to enter into commitments under these terms and conditions. Individuals who do not have full legal capacity may only access the Site and Services with the consent of their legal representative.
- Any legal entity acting through a natural person who has the legal capacity to contract in the name and on behalf of the legal entity.
3.2 Delivery territories
Pre-ordered Pieces and Pieces belonging to Pièce Maîtresse by Laure are offered for sale and can be delivered exclusively to Metropolitan France.
Article 4 - Acceptance of terms and conditionsAcknowledgement of these terms and conditions is evidenced by a checkbox on the order form. This acceptance must be full and complete. Any conditional acceptance is considered null and void. Any user who does not agree to be bound by the present terms and conditions must not access the Site or use the Services.
Article 5 - Registration on the Site
5.1 To register as a User, the User must complete the form provided on the Site. The User must provide all information marked as mandatory.
Registration automatically opens an account in the User's name (hereinafter referred to as the "Account"), giving him/her access to a personal area (hereinafter referred to as the "Personal Area").
Pièce Maîtresse by Laure may also request the User to provide any additional documents or information necessary to implement the sales and/or Services.
The User undertakes to provide such documents and information as soon as possible.
5.2 The User warrants that all information provided by the User to Pièce Maîtresse by Laure is accurate, up-to-date and truthful, and is not misleading. He/she undertakes to update this information in his/her Personal Space in the event of modifications, so that it always corresponds to the aforementioned criteria.
The User is hereby informed and accepts that the information entered for the purposes of creating or updating his/her Account shall constitute proof of his/her identity. The information entered by the User is binding upon validation.
The User may access his Personal Space at any time by entering his login and password. The User is solely responsible for maintaining the confidentiality of his/her login and password, any access to the Site using the latter being deemed to have been made by the User. The User must immediately contact Pièce Maîtresse by Laure at the address and phone number mentioned in article 2 of this Agreement if he/she notices that his/her Account has been used without his/her knowledge. The User acknowledges that Pièce Maîtresse by Laure has the right to take any and all appropriate measures in such event.
Article 6 - Implementation of online sales
The Site makes it possible to e offer pre-orders of Pieces designed by designers through Pièce Maîtresse, according to the methods described below.
- To market Parts created by designers to Users.
This connection, as well as the Services described in Article 8, are provided in a form and according to the functionalities and technical means that Pièce Maîtresse by Laure deems most appropriate.
6.1 Vendor identification and Product characteristics
(i) Pre-ordered Pieces
Pre-ordered Pieces are offered for sale by Designers, identified on the Site, with Pièce Maîtresse by Laure acting solely as an intermediary between Designers and Users and assisting them with any necessary communications between them.
(ii) Pieces belonging to Pièce Maîtresse by Laure
Pieces belonging to Pièce Maîtresse by Laure are offered for sale directly by Pièce Maîtresse by Laure.
Prior to any online order, and in particular in application of the provisions of article L111-1 of the French Consumer Code, the User may take note, on the Site, of the characteristics of each Pre-ordered Piece or Piece belonging to Pièce Maîtresse by Laure that he/she wishes to order.
The reproductions and descriptions of the pre-ordered Pieces or Pieces belonging to Pièce Maîtresse by Laure offered for sale online are as accurate as possible. They only commit the designers for what is precisely indicated.
As far as the sale of handmade pieces is concerned, each piece is unique and may vary slightly in size, shape and color.
6.2 Ordering a Part by the User
To place an order, the User must select the Parts of his choice and place them in his basket. The User may select Parts from different Designers in the same order.
The User can access the basket summary at any time before the order has been definitively validated, and can correct any errors in the information entered. In this summary, the User is informed of any delivery charges relating to his order, depending on his delivery address and delivery method. They can then validate their order.
The User immediately receives an order confirmation e-mail, which constitutes final validation of the order and :
(i) summarizes the elements of the order and the expected delivery date,
(ii) includes the general terms and conditions applicable to the order.
The User must ensure that the contact details provided when placing an order or updating his/her Account are correct, and that they enable him/her to receive order acknowledgement, cancellation and/or confirmation e-mails. Should the User fail to receive such e-mails, he/she should contact Pièce Maîtresse by Laure at the address mentioned in article 2.
Pièce Maîtresse by Laure recommends that the User retain the information contained in the order confirmation. The order and its confirmation are considered received when the parties to whom they are addressed have access to them.
6.3 Prices and methods of payment for Products by the User
6.3.1 Sale pricesThe sale prices of Products are displayed on the Site. They are indicated in euros, inclusive of all taxes.
The applicable prices are those displayed on the Site at the time the order is placed. Pièce Maîtresse by Laure reserves the right to modify its prices at any time, but the Product will be invoiced on the basis of the price list in effect at the time the order is validated.
The sale price of the Products does not include any applicable delivery charges or insurance costs in the event of damage or loss during transport, which are invoiced in addition to the price of the Products purchased. The amount of these charges will be indicated before the User validates the order.
6.3.2 Terms of payment
Unless otherwise indicated on the Site, the full price of the Products is payable at the time the order is placed. Payment may be made online:
- through the secure online payment service Stripe offered by Pièce Maîtresse by Laure on its website,
- or by any other means proposed on the Site at the time of the order.
The User guarantees that he/she has the necessary authorizations to use the chosen method of payment. Pièce Maîtresse by Laure reserves the right to suspend or cancel any order and/or delivery, in the event of non-payment of any sum due by the User, in the event of a payment incident, or in the event of fraud or attempted fraud relating to the use of the Site. Penalties of an amount equal to one and a half (1.5) times the French legal interest rate are automatically applicable to unpaid amounts upon notification of bank payment rejection.
Our products are offered as long as they are visible on the site and within the limits of available stocks. If a product is unavailable after you have placed your order, we will inform you by e-mail. Your order will be automatically cancelled and no bank debit will be made.
6.3.3 Retention of titleEach Designer retains full and complete title to the pre-ordered Pieces sold until full payment has been received by Pièce Maîtresse by Laure.
The contract shall be deemed to have been terminated upon receipt by Pièce Maîtresse by Laure of the letter or writing informing it of such termination.
Pièce Maîtresse by Laure shall not be held responsible for any delay in delivery due exclusively to the Customer's unavailability after several proposed appointments. In the event of termination of the contract as described above, the User will be reimbursed for all sums paid, including delivery charges, within fourteen (14) days of the date on which the contract was terminated.
Pièce Maîtresse by Laure reserves the right, in any event, to contact the User in order to propose alternative solutions for the reimbursement of the price of the Products.
The User will have to express explicitly and on a durable medium his acceptance of the choice of an alternative method of reimbursement. Shipping and return costs will not be reimbursed.
All parts must be delivered within 3 months, except in cases of force majeure: weather, designer's health, supply of raw materials.
6.5 Right of withdrawalThe User has a period of 14 (fourteen) calendar days from the date of receipt of the Products ordered to withdraw from the contract without having to give any reason or pay any penalty, with the exception of the cost of returning the Products, which shall be borne by the User.
The User who wishes to exercise his/her right of withdrawal must send to Pièce Maîtresse by Laure, at the address mentioned in article 2 of these terms and conditions, before the expiry of the above-mentioned period, the withdrawal form annexed to these terms and conditions, duly completed, or a statement clearly expressing his/her wish to withdraw and including the identification of the Product concerned.
The product must be returned directly to Pièce Maîtresse by Laure at 34 boulevard Ornano, 75018 Paris, in its original packaging, without undue delay and no later than 14 (fourteen) calendar days following the User's communication of his/her wish to withdraw. It must be accompanied by a copy of the corresponding purchase invoice and the certificate of authenticity of the Part received. The User is deemed responsible for any damage to the product upon its return to Pièce Maîtresse by Laure.
The User will be reimbursed as soon as possible for all sums paid for the order, minus any return shipping costs, which remain the responsibility of the User.
However, Pièce Maîtresse by Laure reserves the right to postpone the refund until the product has been recovered.
When the User's order covers the Pieces of several Designers, each purchase of a given product constituting a separate sales contract, the right of withdrawal is exercised in the same way as above, product by product.
The right of withdrawal does not apply to products made to the User's specifications or clearly personalized.
6.6 Legal warranties
Users are reminded that, when acting under a legal warranty of conformity, they :
- has a period of two years from the date of delivery of the goods in which to take action;
- may choose between repairing or replacing the product, subject to the cost conditions stipulated in article L217-9 of the French Consumer Code;
- is exempted from proving the existence of the product's lack of conformity prior to sale during the twenty-four months following delivery, except in the case of a second-hand product whose defect is detected more than six months after delivery.
It should also be noted that the legal warranty of conformity applies independently of any commercial warranty that may have been granted.
Any consumer may also decide to invoke the warranty against hidden defects in the item sold, as defined in article 1641 of the French Civil Code. In this case, the consumer may choose between rescission of the sale or a reduction in the purchase price in accordance with article 1644 of the French Civil Code.
6.7 Disputes
Any user may notify Pièce Maîtresse by Laure at contact@piece-maitresse.com, within 14 calendar days of receipt of the product, of any claim concerning a damaged or broken product.
Depending on the case, the declared dispute will give rise either to the restoration or replacement of the product where possible, or to the return of the product and full reimbursement of the User.
If restoration or replacement of the product is impossible, the User will be reimbursed for the full price paid for the product and the corresponding delivery charges, by any appropriate means. This refund will be made as soon as possible and at the latest within 14 (fourteen) calendar days following the date on which Pièce Maîtresse by Laure has informed the User of the impossibility of restoring or replacing the product, and subject to the return of the product.
Article 7 - User Services
Independently of the possibility to purchase Products as described above, Users may subscribe to the newsletter of Pièce Maîtresse by Laure.
Pièce Maîtresse by Laure reserves the right to offer any other Service it deems useful, in a form and according to the functionalities and technical means it deems most appropriate.
Article 8 - User obligations
Without prejudice to the other obligations set forth herein, Users undertake to comply with the following obligations.
8.1 The User, if he/she is a professional, is solely responsible for the implementation of the resale right if he/she decides to resell the product at a later date.
8.2 The User is solely responsible for the accuracy, completeness and updating of the information he/she provides to Pièce Maîtresse by Laure for the purposes of implementing the Services, in particular his/her contact details.
8.3 The User agrees to make strictly personal use of the Website and the Services. Consequently, the User shall not assign, license or transfer all or part of his/her rights or obligations hereunder to any third party in any manner whatsoever.
8.4 The User must take the necessary steps to safeguard by his own means the information in his Personal Space that he deems necessary, no copy of which will be supplied to him.
Article 9 - Prohibited behaviour
9.1 Users are strictly prohibited from copying and/or misappropriating for their own purposes or those of third parties the concept, technologies or any other element of the Pièce Maîtresse by Laure Website.
9.2 The following are also strictly prohibited:
(i) any behavior likely to interrupt, suspend, slow down or prevent the continuity of the Services
(ii) any intrusion or attempted intrusion into Pièce Maîtresse by Laure's systems
(iii) any misappropriation of the Site's system resources
(iv) any action that imposes a disproportionate load on the Site's infrastructure
(v) any breach of security or authentication measures
(vi) any action likely to prejudice the financial, commercial or moral rights and interests of Pièce Maîtresse by Laure or the users of its Site, and more generally(
(vii) any breach of these terms and conditions.
9.3 It is strictly forbidden to monetize, sell or grant all or part of the access to the Services or to the Site, as well as to the information hosted and/or shared therein.
Article 10 - Penalties for breaches
In the event of a breach of any of the provisions of these terms and conditions or, more generally, a breach of applicable laws and regulations by a User, Pièce Maîtresse by Laure reserves the right to take any appropriate action, including without limitation:
(i) suspend access to the Site and Services of the User who has committed or participated in the breach
,(ii) delete the User's Account,
(iv) publish on the Site any information message that Pièce Maîtresse by Laure deems appropriate,
(v) notify any relevant authority,
(vi) take any legal action.
Article 11 - Liability and warranty of Pièce Maîtresse by Laure
11.1 Pièce Maîtresse by Laure undertakes to provide the Services in a diligent and workmanlike manner, it being understood that Pièce Maîtresse by Laure is bound by an obligation of best efforts, to the exclusion of any obligation of result, which the User expressly acknowledges and accepts.
Furthermore, Pièce Maîtresse by Laure shall not be held liable for any damages resulting from misuse of the purchased product.
Finally, Pièce Maîtresse by Laure shall not be held liable for any inconvenience or damage inherent to the use of the Internet, including but not limited to service interruption, external intrusion or the presence of computer viruses.
11.2 Liability and warranty specifically relating to pre-ordered Parts
Pièce Maîtresse by Laure acts as an intermediary in that it provides Designers and Users with technical tools and resources enabling them to enter into a relationship for the purpose of purchasing and/or selling Parts through the Site. Its liability is limited to the provision of these means, as described herein, and to the bringing together of Designers and Users.
Pièce Maîtresse by Laure acts in its own name and does not undertake any legal act in the name and on behalf of the Designers and Users, who contract directly with each other.
Pièce Maîtresse by Laure is not a party to any contracts entered into between Designers and Users, and shall not be liable for any difficulties that may arise in connection with the conclusion or performance of such contracts, nor shall it be a party to any disputes that may arise between a Designer and a User, including without limitation any warranties, representations or other obligations of any kind owed by the Designer or the User.
However, in an effort to constantly improve the quality of the Services, Pièce Maîtresse by Laure invites Users to provide any comments or information they may wish to share with Pièce Maîtresse by Laure regarding the quality of transactions conducted through the Services.
11.3 Liability and warranty specifically relating to Works belonging to Pièce Maîtresse by Laure
Pièce Maîtresse by Laure is the seller of the Parts belonging to Pièce Maîtresse by Laure marketed on the Site.
As such, it is fully responsible for the transaction with the User.
11.4 Pièce Maîtresse by Laure undertakes to carry out regular checks to verify the operation and accessibility of the Site.
As such, Pièce Maîtresse by Laure reserves the right to temporarily interrupt access to the Site for maintenance purposes. Likewise, Pièce Maîtresse by Laure shall not be held liable for any temporary difficulties or impossibilities in accessing the Website caused by circumstances beyond its control, force majeure, or disruptions to telecommunications networks.
11.5 In any event, Pièce Maîtresse by Laure's liability hereunder is expressly limited to proven direct damages suffered by the User.
Article 12 - Intellectual Property
The systems, software, structures, infrastructures, databases and content of any kind (text, images, visuals, music, logos, trademarks, databases, etc.) used by Pièce Maîtresse by Laure within the Website are protected by all applicable intellectual property rights or database producers' rights. All disassembly, decompilation, decryption, extraction, reuse, copying and, more generally, all acts of reproduction, representation, distribution and use of any of these elements, in whole or in part, without the authorization of Pièce Maîtresse by Laure, or of the Designers where applicable, are strictly prohibited and may be subject to legal action.
Article 13 - Advertising
Pièce Maîtresse by Laure reserves the right to insert on any page of the Site and in any communication to Users any advertising or promotional messages in a form and under conditions to be determined by Pièce Maîtresse by Laure.
Article 14 - Links and third-party sites
Pièce Maîtresse by Laure shall in no event be held responsible for the technical availability of websites or mobile applications operated by third parties (including any of its partners) to which the User may have access via the Site.
Pièce Maîtresse by Laure assumes no responsibility for the content, advertising, products and/or services available on such third-party websites and mobile applications, which are governed by their own terms of use.
Neither is Pièce Maîtresse by Laure responsible for any transactions between the User and any advertiser, professional or merchant (including any of its partners) to whom the User may be directed via the Site, nor shall Pièce Maîtresse by Laure be a party to any disputes with such third parties regarding the delivery of products and/or services, warranties, representations or other obligations of such third parties.
Article 15 - Duration of Services, deregistration
15.1 The Services are subscribed to for an indefinite period.
15.2 The User may unsubscribe from the Site at any time, by sending a request to that effect to Pièce Maîtresse by Laure by e-mail, using the contact details mentioned in Article 2.
This unsubscription takes effect within a maximum of 7 (seven) days from the date of the request.
It results in the automatic deletion of the User's Account.
15.3 When the User's unsubscription is due to his refusal to accept the modification of the present terms and conditions as provided for in article 19, the terms and conditions previously accepted by the User will remain applicable until the effective date of his unsubscription.
15.4 Pièce Maîtresse by Laure may terminate the User's access to the Services, without giving any reason, by registered letter with acknowledgement of receipt, subject to one week's notice.
Article 16 - Personal data
Information and data concerning the User are processed by Pièce Maîtresse by Laure. Unless otherwise specified, they are essential for the management of the User's account and access to the Services. This information and data is also kept for security purposes, in order to comply with any legal and regulatory obligations incumbent upon Pièce Maîtresse by Laure, and also to enable it to improve and personalize the services offered and the information sent to the User.
In accordance with the French Data Protection Act no. 78-17 of January 6, 1978, users have the right to access, modify and delete their personal data, in accordance with the law. To exercise these rights, the user simply needs to write to contact@piece-maitresse.com or send a letter to Pièce Maîtresse by Laure, 34 boulevard Ornano, 75018 Paris, giving their full name, e-mail and address. In accordance with current regulations, the User's request must be signed and accompanied by a photocopy of an identity document bearing the User's signature, and must specify the address to which Pièce Maîtresse by Laure is to send a reply.
Article 17 - Modifications
Pièce Maîtresse by Laure reserves the right to modify these Terms and Conditions at any time.
Users will be informed of these modifications by any useful means or, in any event, by access to the modified general terms and conditions of sale at the time of any order placement following the entry into force of these modifications.
Users who do not accept the modified general terms and conditions must unsubscribe from the Site in accordance with the conditions set out in article 18, and must not place an order.
Any User who places an order or uses the Services after the entry into force of the modified general terms and conditions is deemed to have accepted these modifications.
Article 18 - Language
In the event of translation of the present terms and conditions into one or more languages, the language of interpretation shall be French in the event of contradiction or dispute as to the meaning of a term or provision.
Article 19 - Mediation
The User has the right to have recourse, free of charge, to a consumer mediator for the amicable resolution of any dispute with Pièce Maîtresse by Laure concerning the performance of the present terms and conditions, under the conditions set forth in articles L611-1 et seq. and R152-1 et seq. of the French Consumer Code.
Article 20 - Applicable law and jurisdiction
These terms and conditions are governed by French law.
In the event of any dispute concerning the validity, interpretation and/or performance of these terms and conditions, the parties agree that the courts of Paris shall have exclusive jurisdiction, except in the event of mandatory procedural rules to the contrary.
